⊹ PROCESS & Info ⊹

✦ I will NOT take commissions from fresh and/or empty (or about empty), suspicious accounts;✦ Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf;✦ Client provides clear and complete requirements and expectations upfront, including reference materials or assets before payment/work begins;✦ Before the payment for commission the client will be presented with possibly several sketch options to choose from and approve of described idea; for YCH type it will be a sketch from YCH preview fitted for provided character;✦ Major revisions are allowed during the sketch stage. After the sketch is approved and the work has begun, any other excessive or major revisions may require additional charges;✦ In case if in the final artwork there is a mistake in character's deign or if some details mentioned during the discussion before payment are forgotten because of my fault - it will be fixed without attidional charges;✦ Revisions may affect progress and timeline;✦ During the work process on commission the client may request WIP udates at any time and screenshots of the current progression will be provided as soon as I am able to check DMs;✦ I don't accept specific set deadlines of any kind.

⊹ PAYMENT & refunds ⊹

✦ Prices are in USD, and paid via PayPal, Ko-Fi or cryptocurrency (USDT specifically);✦ Detailed payment info will be sent after the sketch is approved;✦ Invoices must be paid within 48 hours, or commission may be cancelled;✦ The work on commission will begin only after 100% prepayment;✦ Prices may vary or change depending on complexity, requirements and/or additional requests;✦ Client agrees that they will not issue chargebacks and the refund policy mentioned below will be followed;✦ Refunds for already finished or delivered commissions are not provided;✦ If client requests cancellation of a personal commission before the payment, all the sketches provided for the commission may be utilised for future YCHs or other orders;✦ No refunds are possible after work begins unless initiated by the artist and except for circumstances as detailed in section below;✦ If I cannot complete the work or there are delays as described in section "Timeline" for unforeseen reasons, the client may be eligible for: a full refund if work hasn't been started yet, or a partial refund according to the amount of work completed;✦ The refund will be issued within the 2 weeks via the original payment method after reaching an agreement on it.

⊹ TIMELINE ⊹

✦ Artwork completion requires 2 weeks minimum, and may take up to 6-7 months depending on each project and due to external problems, like: health or technical issues, prolonged power outrages ect;✦ Timeline depends on commission type, complexity, and workload;✦ Clients will be informed if there are any delays and adjustments to timeline;✦ Final deliverables are provided by using Google Drive or E-mail in PNG formats as applicable. Hosted files will be available to download for unlimited time;✦ Clients must first agree to delays and amendments to timeline exceeding 1-2 months of the work timeline described above through standard communication channels.✦ Clients have the right to request refunds 1-2 month after deadlines according to point above if artwork has not been delivered and there was no agreed upon amendment to the timeline.

✦ I accept characters of any race/species (humans are included and very welcomed! (｡•̀ᴗ-)✧ ), any sex/gender;✦ I'll accept any sfw ideas, as for nsfw - anything in a pin-up/nude/erotic teasing manner is good to go✦ I won't draw straight up sex scenes (aka anything including any type of penetration or active sexual intercourse in any form) or extreme fetishes (like inflation, vore, heavy bdsm, diapers etc);✦ Light kinks such as artistic nudity, bondage, feet, tentacles are okay - just ask me if not sure, I'll happily answer anyone and I'm always open for a discussion;✦ I will not create content that is explicit, offensive, or inappropriate;✦ Specific restrictions include but are not limited to underage characters, mecha/weapons/vehicles, excessive muscles/fat, gore, copied styles, and gender identities or cultures that I may not be able to portray authentically;✦ I reserve the right to decline anything I am not comfortable with, or if I feel like I could not bring justice to the commission.

This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the terms above and below.

✦ By default, the Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and Work in Progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch, Youtube etc) and more, exempting when some or all of these rights are transferred to the client under express agreement or project specifications;✦ The Artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe the client's intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks;✦ The Artist retains the non exclusive rights to sell merchandise and prints of their work, sell higher-resolution files and WIP stages of the Commission as part of image packs, Patreon rewards or similar, unless exclusive commercial rights are purchased by the Client;✦ Clients receive non-transferable usage rights to the Work for personal use.
Personal use means: display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where no monetization of, or of content featuring, the Work is involved;✦ Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on where possible;✦ Commercial usage rights are not included in general commissions, unless specified in the commission type or project specifications listed on the Artist’s websites (i.e. vtuber models, stream overlays, emotes, and so forth), or is purchased by the Client and agreed upon;✦ In the case of original design work and assets for the purpose and definition of the Client's brand identity such as character design, logo design, and more, intellectual property rights of the designs and their likeness are exclusively transferred to the Client for use, production and modification purposes, commercial or personal;✦ Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited;✦ Additional charges will be required for commercial usage if not included in the project type, listing, or specifications, typically 2x of the original cost.
